1. Acceptance of Terms

By booking or paying for a vehicle inspection service with Impact Inspections ("we," "our," or "us"), you ("the Client") agree to be bound by these Terms of Service.

2. Nature of Services

Scope of Inspection: Our services comprise a visual and mechanical assessment of the vehicle, including heavy vehicles, trucks, and trailers, at the specific date and time of the inspection.

Not a Guarantee: The inspection report is an expert opinion based on the condition of the vehicle at the time of assessment. It is not a warranty or guarantee against future defects, breakdowns, or hidden underlying issues that cannot be identified without dismantling components.

Exclusions: Unless explicitly stated, our inspections do not include dismantling parts, internal engine or transmission assessments, or verifying the legal title and registration history of the vehicle, including PPSR checks, which remain the Client's responsibility.

3. Bookings, Pricing, and Payment

• Currency: All prices quoted and transactions processed are in Australian Dollars (AUD).
• Payment Terms: Full payment is required prior to the release of the final inspection report, unless an alternative prior arrangement has been made.
• Cancellations: Cancellations made within 24 hours of the scheduled inspection time may incur a cancellation fee to cover travel and scheduling losses.

4. Client Responsibilities

• Access: The Client must ensure that the vehicle is accessible, on safe and level ground, and has sufficient fuel for a road test if applicable and legally permitted.
• Permission: If the vehicle is located at a dealership or private seller's premises, the Client is responsible for obtaining permission from the owner for Impact Inspections to conduct the assessment.

5. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law:

• Impact Inspections shall not be liable for any indirect, incidental, or consequential damages, loss of profits, or loss of use arising from the purchase or operation of the inspected vehicle.
• Our total liability for any claim arising out of the inspection service is strictly limited to a refund of the inspection fee paid by the Client.

6. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
